These Terms of Sale (hereinafter "Terms") govern transactions carried out through the SnapSpot Paris platform (hereinafter the "Platform"), accessible at snapspotparis.com.
They cover the online booking and payment of photo sessions between a Client and an independent Photographer, as well as the supply by SnapSpot Paris of its intermediation service.
These Terms complement the Terms of Use. In the event of a conflict on a transaction-related point, these Terms prevail. Any booking implies full and unreserved acceptance of these Terms.

SnapSpot Paris acts exclusively as an intermediary and a provider of intermediation services. The photographic service contract is concluded directly between the Client and the Photographer. SnapSpot Paris is not a party to that contract, is not the seller of the photographic Service, and does not employ the Photographers, who operate as independent professionals.
SnapSpot Paris sells only its own service: the connection, booking management, secure collection of payment and disbursement of funds. The proper performance of the Service is the sole responsibility of the Photographer.
Prices are shown in euros (EUR), inclusive of all taxes. The price shown to the Client includes the Photographer's service and the SnapSpot Paris service fee.
The service fee is invoiced by SnapSpot Paris under the small-business VAT exemption scheme: VAT not applicable, article 293 B of the French General Tax Code. Any VAT applicable to the photographic service depends on each Photographer's own tax situation.
A verified account (confirmed email address) is required to book.
Payments are processed by Stripe Payments Europe Ltd, a PCI-DSS certified payment service provider. SnapSpot Paris never stores users' bank details.
Pre-authorisation and deferred capture ("Pay & Hold"): when a booking is requested, the total amount is pre-authorised on the Client's card but not immediately charged. The charge (capture) only takes place after the Photographer confirms the booking. If the Photographer does not confirm within the allotted time (see article 8), the pre-authorisation is automatically released and no amount is charged.
When a booking results from a personalised offer issued by the Photographer and accepted by the Client, payment may be charged immediately, as the Photographer has already agreed to the slot.
Funds are paid to the Photographer via Stripe Connect, less the service fee. By paying, the Client also accepts Stripe's terms.
Upon receiving a booking request, the Photographer has 24 hours to confirm or decline it:
The Service is performed on the date, at the time and at the location(s) agreed. The performance conditions (duration, number of photos, deadline and method of delivery of the files) are those defined in the booked pack and, where applicable, agreed between the parties via the Platform's messaging.
Delivery of the photographs (timeframe, format, number) is the Photographer's commitment as announced in their pack. SnapSpot Paris does not itself handle delivery of the files.
No right of withdrawal: in accordance with article L221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure service provision to be supplied on a specific date or with a specific frequency. By booking a photo session on a specific date, the Client expressly waives their right of withdrawal. The cancellation conditions below (article 11) apply instead.
Each pack is associated with a cancellation policy (flexible, moderate or strict), displayed before booking. The applicable policy is fixed at the time of booking.
Refunds are issued via Stripe to the original payment method, within a reasonable time. The service fee may be retained in the event of late cancellation by the Client, within the limits of the applicable policy.
If the Photographer cancels a confirmed booking, the Client is refunded 100% (service and service fee). Repeated cancellations by a Photographer may lead to suspension of their account.
In the event of force majeure (weather making the session impossible, etc.) preventing performance of the Service, the parties shall endeavour to agree on a reschedule. If rescheduling is not possible, the Client is refunded.
For a booking benefiting from a promotion (referral, affiliate or discount code), in the event of cancellation or refund, a retention corresponding to the costs already incurred (referral/affiliate reward paid and discount granted), capped at EUR 15, is deducted from the refund. This retention, shown before payment, is solely intended to cover those costs and generates no profit for the Platform.
In the event of a problem with a Service (Photographer absent, photos not received, quality, behaviour, etc.), the Client is invited to report the problem directly from the Platform, using the report function attached to their booking, before any chargeback request to their bank.
SnapSpot Paris operates an internal mediation procedure: gathering the Client's and Photographer's accounts, then a decision that may go as far as a full or partial refund. This procedure aims for an amicable and rapid resolution of the dispute.
The Photographer receives the price of their Service, less the SnapSpot Paris service fee (15%), via their Stripe Connect account. The Photographer is solely responsible for their tax and social obligations (turnover declaration, VAT where applicable, contributions). A summary of the service fees charged is made available to the Photographer.
As an intermediary, SnapSpot Paris cannot be held liable for the quality, punctuality, compliance or delivery of the photographic Services, which are the sole responsibility of the Photographers. The liability of SnapSpot Paris is limited to the proper supply of its intermediation and payment-collection service.
SnapSpot Paris cannot be held liable in the event of force majeure within the meaning of article 1218 of the French Civil Code.
Data collected as part of a transaction is processed in accordance with our Privacy Policy and the GDPR (EU Regulation 2016/679).
In accordance with article L612-1 of the French Consumer Code, any consumer Client may use a consumer mediator free of charge to settle a dispute with SnapSpot Paris amicably, after first making a written complaint.
