Terms of Use

1. Purpose

These Terms of Use (hereinafter the "Terms") govern the use of the SnapSpot Paris platform (hereinafter the "Platform"), accessible at snapspotparis.com.

The Platform is published by SnapSpot Paris, trade name of a French sole trader registered under SIRET 942 207 580 00013. The publisher's full identity is set out in the legal notice.

The Platform is a service connecting clients (hereinafter the "Clients") with independent photographers (hereinafter the "Photographers") for photo sessions in Paris and the Ile-de-France region.

2. Acceptance of the Terms

Registering and using the Platform implies full and unreserved acceptance of these Terms. If you do not accept these Terms, you must not use the service.

SnapSpot Paris reserves the right to amend these Terms at any time. Users will be informed of any substantial change by email or in-app notification. Continued use of the service after a change constitutes acceptance of the new Terms.

3. Registration

3.1 Registration requirements

• Clients: be at least 15 years old (Art. 8 GDPR). Minors aged 15 to 18 must have the authorisation of their legal guardian.
• Photographers: be at least 18 years old, and be duly authorised to carry out a photography activity (sole trader, company, craftsperson, etc.).

3.2 User account

Each user undertakes to:

• Provide accurate and up-to-date information when registering;
• Keep their login credentials confidential;
• Immediately notify SnapSpot Paris of any unauthorised use of their account.

An account is strictly personal and may not be transferred or shared.

3.3 Photographer verification

Photographer profiles are subject to manual verification by the SnapSpot Paris team before activation. This verification covers the consistency of the profile and the quality of the portfolio. SnapSpot Paris reserves the right to refuse or suspend a photographer profile without having to justify its decision.

4. Service description

• Search for photographers by location, specialty, availability and price;
• Access to portfolios, reviews and detailed photographer profiles;
• Online booking and payment of photo sessions (via Stripe);
• Built-in messaging between Client and Photographer;
• Photo publishing by photographers (Snappies / Feed);
• Schedule and billing management for photographers.

5. Bookings and payment

5.1 Booking process

1. The Client chooses a photographer, a pack, a date, a time and one or more locations;
2. The Client proceeds with online payment via Stripe;
3. The booking moves to "pending" status and the Photographer is notified;
4. The Photographer confirms or declines the booking before the deadline communicated to them (article 8 of the Terms of Sale); after that deadline the request is automatically cancelled at no cost to the Client;
5. If confirmed, both parties receive a confirmation email.

A booking resulting from a personalised offer from the Photographer, accepted by the Client in the messaging, is paid immediately and confirmed as soon as payment is made (article 7 of the Terms of Sale).

5.2 Prices and commission

Displayed prices include the SnapSpot Paris commission (service fee). The breakdown (photographer's price + service fee) is shown before payment. All prices are in euros (EUR), inclusive of tax.

5.3 Secure payment

Payments are processed by Stripe, a PCI-DSS certified payment provider. SnapSpot Paris never stores your bank details. By paying, you also accept Stripe's terms.

6. Cancellation and refund

Each photographer pack is associated with a cancellation policy (flexible, moderate or strict), clearly displayed before booking.

Cancelling within the hour: whatever the policy, a cancellation made within one hour of the booking being recorded (when the Client proceeds to payment) is refunded in full, subject to the retention applicable to promotional bookings (article 11.6 of the Terms of Sale) and provided that the planned end time of the session has not been reached.

End of the planned time slot: from the planned end time of the session, a confirmed booking can no longer be cancelled or moved; a problem (Photographer absent, service not as ordered) is reported from the booking. Rescheduling a session before that time is described in article 11.7 of the Terms of Sale.

Request not yet confirmed: as long as the Photographer has not accepted the booking request, the Client may cancel it at any time, whatever the policy and however little time remains before the session; it is then returned in full, with no fee or retention, as when the Photographer declines or does not respond (article 8 of the Terms of Sale). The policies below apply to confirmed bookings.

6.1 Flexible policy

• Free cancellation (100% refund) up to 24 hours before the session starts;
• No refund less than 24 hours before the start.

6.2 Moderate policy

• Free cancellation (100%) up to 48 hours before the session;
• 50% refund between 48h and 24h before;
• No refund within the last 24 hours.

6.3 Strict policy

• Free cancellation (100% refund) up to 7 days before the session starts;
• 50% refund between 7 days and 48 hours before the start;
• No refund less than 48 hours before the start.

6.4 Cancellation by the photographer

If the Photographer cancels a confirmed booking, the Client is refunded 100%. Repeated cancellations by a Photographer may lead to suspension of their account.

7. User obligations

7.1 Common obligations

All users undertake to:

• Use the Platform fairly and in accordance with these Terms;
• Not publish illegal, offensive, defamatory content or content infringing third-party rights;
• Not attempt to bypass the Platform to avoid paying the service fees;
• Respect the intellectual property of content published by other users.

7.2 Client obligations

• Show up at the appointment on time and at the agreed location;
• Communicate any information useful to the proper running of the session;
• Treat the Photographer with respect and courtesy.

7.3 Photographer obligations

• Provide accurate information about their skills, prices and availability;
• Honour confirmed bookings;
• Deliver the photos within the announced timeframe;
• Hold the insurance and authorisations required to carry out their activity;
• Respect the image rights of the people photographed.
• Only publish photos from a session on the public SnapSpot feed with the Client's explicit consent (consent checkbox in the booking brief). The Client may withdraw this consent at any time; the photos concerned must then be removed.

8. Messaging and moderation

The Platform provides an internal messaging system between Clients and Photographers.

• Messages must remain courteous and related to the photographic service;
• It is forbidden to use the messaging for commercial, advertising or solicitation purposes;
• In the event of a dispute, report or abusive behaviour, the moderation team may access the messages exchanged in order to resolve the matter fairly (see our Privacy Policy, section 4).

9. Intellectual property

9.1 Platform content

All elements of the Platform (interface, design, code, text, logos) are the property of SnapSpot Paris and are protected by intellectual property law.

9.2 User content

Photographs and content published by Photographers (portfolio, Snappies) remain their property. By publishing content on the Platform, the Photographer grants SnapSpot Paris a non-exclusive, free, worldwide licence to display, reproduce and distribute that content as part of the operation of the service.

This licence ends when the content or account is deleted by the Photographer.

10. Liability

10.1 Liability of SnapSpot Paris

As an intermediary, SnapSpot Paris cannot be held liable for:

• The quality, punctuality or compliance of the photographic services;
• The actions of users on or off the Platform;
• Data loss due to circumstances beyond our control;
• Temporary unavailability of the service.

SnapSpot Paris nevertheless undertakes to implement all reasonable means to ensure the proper functioning and security of the Platform.

10.2 Force majeure

SnapSpot Paris cannot be held liable in the event of force majeure within the meaning of article 1218 of the French Civil Code (natural disaster, widespread outage, cyberattack, etc.).

11. Suspension and termination

SnapSpot Paris reserves the right to suspend or delete a user's account in the event of:

• Breach of these Terms;
• Fraudulent or abusive behaviour, or behaviour harmful to other users;
• Publication of illegal or inappropriate content;
• Prolonged inactivity (more than 24 months without login, with prior notice).

Users may delete their account at any time from their profile settings (see Privacy Policy, section 8).

12. Applicable law and disputes

These Terms are governed by French law.

In the event of a dispute, the parties undertake to seek an amicable solution. Failing this, the dispute shall be submitted:

• For consumers: to the courts of the consumer's place of residence or of SnapSpot Paris's registered office, at the consumer's choice (Art. R631-3 of the French Consumer Code);
• For professionals: to the competent courts of Versailles.

In accordance with article L612-1 of the French Consumer Code, you may use a consumer mediator free of charge. Designated mediator: Mediation de la consommation - AME (www.mediationconso-ame.com).
